Terms of Service
These Terms of Service (“Terms”) govern your use of BuildBox.OS, provided by Troy Steel Pty Ltd (“we”, “us”, “our”). By accessing or using the service, you agree to be bound by these Terms.
1. Acceptance of terms
By creating an account, accessing, or using BuildBox.OS, you confirm that you are at least 18 years old and have the authority to enter into these Terms (on your own behalf or on behalf of your organisation). If you do not agree, you must not use the service.
2. Service description
BuildBox.OS is a template builder, deployment engine and business-system platform designed for African SMEs. Features include template selection, AI-assisted customization, preview, publishing, customer relationship management, invoicing, and subscription management.
3. Account & acceptable use
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must not:
- Use the service for any unlawful purpose
- Send spam, phishing or malware through the platform
- Infringe intellectual property rights of others
- Attempt to probe, scan, or test the vulnerability of our systems
- Scrape, reverse engineer, or circumvent technical limits
- Resell or redistribute access without our written consent
4. Intellectual property
Troy Steel Pty Ltd retains all ownership rights in BuildBox.OS, including software, documentation, templates, branding and underlying code. We grant you a limited, non-exclusive, non-transferable licence to use the service within the bounds of your selected subscription plan. You retain ownership of the content you create using the platform.
5. Payments & subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Subscription fees are billed in advance on a recurring basis according to your selected plan. Taxes are calculated and remitted by Paddle in accordance with local regulations. For full payment, billing, tax, cancellation and refund mechanics, please refer to Paddle's Buyer Terms.
You may upgrade or downgrade your plan at any time. Upgrades take effect immediately and are prorated. Downgrades are scheduled for the end of your current billing period.
6. Service level & warranties
We strive to maintain high availability, but we do not guarantee uninterrupted or error-free performance. The service is provided “as is” without warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.
7. Suspension & termination
We may suspend or terminate your access if you:
- Materially breach these Terms
- Fail to pay subscription fees when due
- Engage in fraud, security interference, or illegal activity
- Repeatedly or seriously violate our acceptable-use policies
Upon termination, your right to use the service ceases immediately. We will provide an export window for your data where technically feasible.
8. Liability
To the maximum extent permitted by law, our aggregate liability is capped at the total fees paid by you in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages (including lost profits, data loss, or goodwill), except where prohibited by law. Nothing in these Terms excludes liability for fraud, death, or personal injury.
9. Governing law & disputes
These Terms are governed by the laws of South Africa. Any dispute arising from these Terms will be resolved in the courts of Johannesburg, South Africa, unless otherwise agreed in writing.
10. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the service. Continued use after changes take effect constitutes acceptance of the revised Terms.
